TERMS OF USE

1. Purpose

These terms of use (the "Terms") govern access to and use of the scoreshark.io website by anyone who visits it (the "User").

Using the site means accepting the Terms. Paid subscriptions are governed by the Terms of sale, which prevail over these Terms for everything related to subscribing, payment, withdrawal and cancellation.

2. Publisher

The site is published by ScoreShark. The publisher's identity, the publication director and the hosting provider are listed in the Legal notice.

3. Access to the site

Public pages (scores, rankings, tournaments, articles) are freely accessible. Some analyses are reserved for people who have created a free account. Other content is reserved for subscribers, under the conditions described on the Pricing page.

ScoreShark uses reasonable means to keep the site available, without guaranteeing uninterrupted availability. The site may be interrupted for maintenance, updates or technical incidents, without compensation for the User. For an ongoing subscription, the Terms of sale apply.

4. User account

Creating an account requires a valid e-mail address. The User provides accurate information and keeps it up to date.

Login credentials are personal and confidential. The User does not share them with anyone and notifies ScoreShark without delay at [email protected] if they suspect unauthorised use of their account.

ScoreShark may suspend or close an account in case of a breach of these Terms, after informing the User where possible. The User can delete their account at any time from their account area.

5. Intended audience

ScoreShark's content is intended for people aged 18 and over. A User who creates an account confirms that they are of legal age. Gambling is prohibited for minors under French law (article L320-7 of the Code de la sécurité intérieure).

6. Nature of the content

ScoreShark is a sports analysis media outlet. The content published (analyses, expert opinions, statistics, match data, articles) is editorial and statistical content provided for information purposes.

No content constitutes betting advice or an encouragement to gamble. No analysis guarantees a result: sport remains uncertain and an analysis may turn out to be wrong.

ScoreShark is not a gambling operator licensed by the French National Gambling Authority (ANJ). The site offers no game, opens no gaming account and accepts no deposit of money or any money to play.

The odds displayed are information taken from third-party sources. They may be inaccurate, incomplete or delayed. ScoreShark does not guarantee their accuracy or timeliness.

7. Prohibited uses

The User must not:

  • extract, collect or copy all or part of the site or its data by automated means (robots, scripts, content scraping), except indexing by search engines that follow the site's rules;
  • reproduce, distribute or republish the content systematically, in particular the analyses, on any medium;
  • circumvent access restrictions, technical limitations or security measures;
  • share their account or pass on to third parties content reserved for account holders or subscribers;
  • harm the security, integrity or operation of the site, or attempt to access it without authorisation;
  • use the site for unlawful purposes or in breach of these Terms.

In case of a breach, ScoreShark may restrict access, suspend or close the account concerned and take any appropriate action.

8. Intellectual property

The site's content (analyses, texts, visuals, logo, trademarks, databases, code) is protected by copyright, trademark law and database producers' rights. It belongs to ScoreShark or its partners.

Any reproduction, representation, extraction or reuse, in whole or in part, without prior written permission is prohibited, except for strictly private use and subject to the exceptions provided by law, in particular short quotations with attribution of the source (article L122-5 of the French Intellectual Property Code).

The names of players, tournaments, tours and third-party brands mentioned on the site belong to their respective owners and are used for information purposes only.

9. Links and third-party services

The site may contain links to third-party websites and relies on third-party services (payment, authentication, notifications, measurement). ScoreShark has no control over these sites and services and is not responsible for their content, availability or practices. Their use is governed by their own terms.

10. Liability

The User uses the site and its content at their own risk. They remain solely responsible for the decisions they make based on the information published.

To the extent permitted by law, ScoreShark is not liable for indirect damage, data loss or financial loss related to the use of the site, an interruption of the service or an inaccuracy in the content.

Nothing in these Terms excludes or limits the mandatory rights granted to consumers, or ScoreShark's liability for gross negligence or wilful misconduct.

11. Personal data and cookies

The processing of personal data is described in the Privacy policy. The trackers used by the site and how to manage them are described in the Cookie policy.

12. Changes to the Terms

ScoreShark may change these Terms at any time, in particular to follow a change in the site or in regulations. The version in force is the one published on this page, with its update date. Using the site after publication means accepting the updated Terms.

13. Governing law and disputes

These Terms are governed by French law. In case of difficulty, the User first contacts ScoreShark to look for an amicable solution.

For a dispute about a subscription, consumer mediation and remedies are described in article 11 of the Terms of sale. Failing an amicable solution, French courts have jurisdiction, subject to the rules protecting consumers.
